Analysis Of The Affordable Care Act - 1047 Words

To the Editor: Under the Affordable Care Act, health insurance companies cannot refuse anyone coverage or charge a higher amount for any health problems that existed before a new health coverage plan begins. However, with the Republican agenda to â€Å"repeal and replace† Obamacare, coverage for pre-existing conditions could be on the chopping block. The proposed Graham-Cassidy Health Care Bill gives flexibility to the states to design their own health care systems. With this, states could waive the provision that caps how much insurance companies can charge; thus, they could charge those with pre-existing conditions more (Collins, 2017). Furthermore, this plan would also allow states to waive certain essential health benefits covered†¦show more content†¦However, none of the proposed Republican plans have brought forth legitimate plans to solve these issues. The Graham-Cassidy Health Care Bill would discontinue the individual mandate that requires everyone to have health insurance, or else pay a fine. This was implemented under the Affordable Care Act to bring more healthy people into insurance plans to lower the premiums for everyone on the plan. The Republican plans propose a continuous coverage requirement to keep healthy people on insurance. One idea is to charge a 30% higher premium for a year to those that had a 63-day insurance lapse over the previous year. According to Robertson (2017), â€Å"the waiver as proposed in the new amendment would enable states to instead allow insurers to price plans based on health status for those without continuous coverage. So they could be charged more than the 30% surcharge.† However, those that are the most likely to have a lapse are the lower socioeconomic classes, but they are also unlikely to rejoin the marketplace because they cannot afford the increased premiums. Ezra Klein (2017) explains how the individual mandate was already too weak to bring enough healthy individuals into the marketplace, but he also states that the continuous coverage requirement is weaker. It could lead to a death spiral, which happens as premiums rise and a group of healthy people leaves the insurance plan causing premiums to rise again and another group of healthy individuals toShow MoreRelatedAnalysis Of The Affordable Care Act810 Words   |  4 Pages The title of the article found in the latest releases of the Kaiser Family Foundation website is Ten Ways That the House American Health Care Act Could Affect Women. They were wonderful parent’s and they raised my brother and sister and I with much love and care. They were there for us whenever we needed them and for whatever reason. Whether it was financial support or moral support they never failed to be there for any of us. We weren’t by any mearns financially well off, my father owned a hardware store and my mother was a secretary for the board of education. It didn’t matter to them though, because their kids always came first and if we needed something, they would find a way to get it. I remember one time my father coming home with a flu gal horn in his hand for me. I asked him where he got it and he told me that he had traded it for an antique ax and $50. 00. He didn’t have the money to go buy a new one, but he was willing to sacrifice something that he cared about for something he cared more about, Me. He loved collecting antiques and the ax was one of his collectables. This was a common thing in our household. I remember growing up having older parent’s than most all of my friends. This was a real worry for me as a kid and when they started to get older and have some health problems my fears became a reality. I always told my mother who lived to be 86 that she would never have to worry about going into a rest home, that I would take care of her and she could always come live with me and my family. My father died at the age of 63 after having heart problems from what I feel was a result of a life of smoking two packs of cigarettes per day. As I said before, my parent’s were wonderful parent’s and took care of us as best as any parent’s ever could. It’s funny how things go full circle in life. Your parent’s take care of you and worry about you when your young and then it’s your turn to return the favor in their later years. Because of their love for me and the love and respect that I had for them, I had always felt a responsibility for them and would do whatever I could in their later years. This article is an attempt to try to help others that are going through what my family and I did while taking care of our elderly parent’s. I will attempt to go through some different stages that will hopefully help ease some of the burdens that you may face. I hope you will find the following information in someway helpful. As Time Begins to Pass, Driving Can Be A Challenge: When our parent’s begin to hit those later years it can be somewhat like walking on eggshells. You might start seeing some small things that concern you, but try not to blow them out of proportion. They might be still driving their car and the thought might come to you to ask them to stop driving or you might even be so bold as to take their keys from them. This is where many children make a big mistake. Remember, it is very important for the elderly to be able to maintain self worth and dignity in their later years. Having a son or daughter tell them what to do or what not to do can really hurt their feelings and cause a lot of problems. It’s easy to understand this concern if the paren’t has had some accidents or is not able to drive safely where they might be a risk to themselves or others on the road, but if this is not the case, respect them enough to allow them to have input into what they are wanting to do. The Milwaukee Wisconsin Journal Sentinel published a very good article online on December 26, 2012 where they outlined many good and useful tips for older drivers and their families. They stated that it’s important to help older drivers stay safe behind the wheel for as long as possible. Adult children can help aging parent’s regularly maintain their vehicles. And if it’s time for a new car, adult children can help identify choices with new technologies that can enhance safe driving, like reverse monitoring systems. Older drivers can brush up on their driving skills with AARP Driver Safety’s course, which is specifically designed to help people 50 and older refresh their driving skills. Family members should observe an older loved one’s driving by taking a ride as passenger and keeping an eye out for warning signs. It’s important to look for changes in driving abilities. These signs include: – Frequent â€Å"close calls† or near-crashes. ?- Unexplained dents or scrapes on vehicles, fences, mailboxes, garage doors, etc. ?- Getting lost, even in familiar locations. ?- Difficulty seeing or following traffic sig nals, road signs and pavement markings. ?- Slower responses to unexpected situations, trouble moving the driving foot from the gas to the brake, and confusing the two pedals. ?- Misjudging gaps in traffic at intersections or on highway entrance and exit ramps. ?- Experiencing road rage or inspiring it in other drivers. ?- Easily becoming distracted while driving. ?- Difficulty turning around to check the rear view while backing up or changing lanes. – Receiving multiple tickets or warnings from law enforcement officers. ?Third, if you notice a pattern of warning signs and an increase in frequency, then it’s time to initiate a conversation. â€Å"It’s important that the right person initiate the conversation,† says Jodi Olshevski, a gerontologist and assistant vice president at The Hartford. â€Å"Research indicates that 50 ppercent of married drivers prefer to hear about driving concerns from their spouses first, then doctors and finally adult children. Whowever initiates the conversation should have a sthrong rapport with the older driver. † ?Avoid bringing up the topic of driving during family gatherings. Instead, look for a quiet, private time when all parties involved will have privacy and minimal distractions. If the case is serious and they should not be behind the wheel then sit down with them and discuss it in a very loving way and try hard not to talk to them in a demeaning way. Remember, they have lived along time making their own decisions and have done pretty well on their own. They deserve to have your respect as they always have. Many times just sitting down with the elderly paren’t and discussing your concerns and worries and why you feel the way you do, will allow them to look at things in a different way. Remember, they loved and took care of you for a long time and they cared about how you felt and I’m sure they still do. If you truly show your love and concern for them as you speak to them, showing them respect and dignity, they might surprise you and see things more your way. Young or old nobody likes to be told what they are going to do. Often, if your concerns are put to them as â€Å"What do you think about this mom†, or â€Å"Dad, don’t you think it would be better if we did this†, they would be more excepting of the suggestion and not be as defensive. If the situation is serious and they will not listen after all you have done, it might require a more drastic approach. I feel that it is very important to hold the relationship between our parent’s as most important. Having said that, you may not agree with the following tactic, but it may very well solve the problem. If I knew that my mother was dangerous on the road and that her well being and the well being of many other innocent people were at risk, I might be so inclined to contact a police officer friend or just talk to one about your concerns. I might explain to the officer that I feel that my mother could be a danger on the road and would he be willing to keep an eye out for her and see what he thinks. This is more easily done in smaller towns and communities but if you have that luxury, it might be worth your wild. I’m not an advocate for telling you to be dishonest to your paren’t or sneaky, but we are talking about their well being here. Sometimes the less you say can be the best, if you know what I mean. If the officer feels that she is unsafe in her ability to continue to drive then he can take the needed steps on his end. This will accomplish the goal of her safety and also help you save face in her eyes as well. I do feel that you must be prepared to take up the slack in the event they voluntarily retire the keys or if they are taken by other mearns. If they lose their ability to move around that they have enjoyed for many years, this is going to be a life-changing event. As their offspring, we’ll need to be sensitive to this and be willing to make arrangements for them or be willing to transport them ourselves. Depending on the number of siblings we have and the availability of each, we can have a family meeting and work out who could be responsible for what week or what day or what church meeting or what ladies or men’s organization we would be able to drive them to. I would suggest that the paren’t not be in attendance at this meeting. I remember times when my own family meetings were taking place and my mother was sitting there. Every once in a while there would be a conflict amongst us siblings with who could or couldn’t do what and my mother would just get frustrated and speak up and say, â€Å"Just forget it, I don’t need it†, or something like that. These types of situations can really hurt the paren’t in so many ways. Most of all it makes them feel as though they are burdensome and can start them on a path of depression. Depression is a whole other issue that we will deal with later, but it is very serious. We never want our loved ones feeling in anyway that they are a burden. I always tried my best to let my mother and father know how much I enjoyed being there for them. I’m not saying that every moment was a vacation, but for the most part, I did enjoy being there for them and seeing the gratitude in their eyes. The paren’t doesn’t need to be in the meeting anyway to solve logistical issues of who is going to transport and when or who is going to stay and what night. The paren’t doesn’t need to be in on who will be taking care of getting the medicines ready each week. They just need to know that they don’t have to worry about it. The less they worry the better off they are. Bottom line is, work around them and make their lives easier. Business Affairs And The Elderly: There are many things to think about when it comes to taking care of business concerns. Taking charge of making sure the paren’t’s bills are taken care of is a huge worry off their minds. It’s important to know where all the legal documents are and just what there is to take care of. Make a list of all bills that need to be taken care of and the addresses to where the payments need to be sent. Check to see if there’s any balance on any of the accounts. Find out if there is any extra bills that are not utility type bills such as, monthly donations or Christmas club dues, or maybe they are sponsoring an over seas child each month. Evaluate at this time, (with the paren’t) if the budget can continue to fund these things. In today’s world the task of taking care of the monthly bills is getting easier everyday, with the use of the internet. By going online, most bills can be paid on a monthly basis now with very little effort. This will most likely have to be set up for them being as though most elderly people are not internet savvy. I would also recommend if possible in your area, to have your paren’t’s utilities put on a budget with utility companies. This will allow them to make easier payments and free up some of their capitol for other uses. Bills that are not reoccurring, like groceries, getting their hair cut or that weekly massage, will have to be taken care of the old fashion way, just do it for them. When it’s time to get groceries, go for them or have someone go, or if they feel they want to go, go with them. This is another example of allowing them to hold onto their dignity longer. Tell them, you love going to the store with them and ask them not to take that pleasure away from you. This gives them another example of your love for them and also allows them to get the help they need with getting the groceries. It may be a smart business move to put any large assets such as vehicles or the family home place and property into the names of all the children. It could probably be a smart move to talk to a lawyer that deals with estate planning who also offers Medicaid planning services in case you paren’t might need government assistance with in the next three years. Often, if a paren’t has to go t o a rest home facility and they have much in the way of assets, they might find themselves in a bad financial spot, which could effect their forfeiting their property. Transferring assets may also put those that are receiving such property, eligible for being taxed on it. These are important things to think about and should be discussed with a qualified lawyer. Someone will have to agree to take on the position of power of attorney. If there’s only one child involved the decision is easy, but if there are more it can become a little bit troublesome. If your paren’t has already decided which child this duty will fall to, do them a favor and respect those wishes. This is something that is probably going to be worrisome to them anyway. They will most likely worry that they may be hurting some ones feelings. Do all that you can do to let them know that you support what they have decided. It can be a lot of work being the person with power of attorney or the executor of the will. This person has to be willing to do the paper work and the research of assets if it is unknown. This person also bears the burden of making the final decision on most all the legal decisions to be made. If you’re not the one chosen in the family to do this job, please be patient with the one that is and show them your support. Usually, it is customary that the person doing this job is compensated by at least $5000. 00 for taking it on. This should not be a source of contention between siblings because the job will require much work to do it right. My sister did it for our family and did it very well. She is the one that found the extra money that we (and our mother) didn’t know she had. She spent many hours on the job and did it graciously. She didn’t take a penny extra for it and that was an honorable thing to do if you’re so inclined to do so. It is also recommended that once the power of attorney has been decided on, to also have detailed in a document that names a second person who will take a look at all the bank statements on a monthly basis and do an analysis of all the financial records yearly. This person can be another family member or a professional accountant. It’s also important to try to find extra money for a later time. Using financial tools such as reverse mortgage can improve the cash flow of the elderly. Checking for benefits that your parent’s might be eligible for such as a reduction in their heating bills or help with their prescription drugs can really make a difference. There are many avenues to get help out there but actually only about half the people who qualify for such help actually use it. When making purchasing or financial decisions on behave of your paren’t, it is also wise to consult with other siblings if there are any. Don’t make the mistake of making an important, or even a not so important decision without consulting the family involved. This will only open your self up to problems down the road. Someone will always have a different way to have handled it and will tell you about it. When you are in charge of the bills and the worries that come with it, the last thing you want to hear from a sibling is that you didn’t do it the right way or that your decision wasn’t done fairly. Look ahead and prepare in advance. Even the closes families have issues over money. Don’t be so naive as to think that yours will not. When you have done all that you can do to make the decision and the family can’t seem to come to an agreement on something, then it is your job as the executor or power of attorney to make that decision and everyone should support that decision, even if they don’t agree to it. The only other thing that you can do it to agree on (with the paren’t) another non bias person, sort of a mediator to make any decisions that are in dead lock. This way no family member can be upset with any other family member. All these issues need to be understood and worked out well in advance so that there is no questions or misgivings later. It wouldn’t even be a bad idea for all family members to sign an agreement stating that they understand the way that procedures will go forth and they will abide by them. Of course, if the paren’t is still healthy and able to make clear decisions, they are the ones that should set for the procedures and how things will be handled and they will be the ones having everyone else do the signing of understanding. Assets: It’s important to make sure the family knows just what the assets are. I know before my mother passed away, she was very worried that there wouldn’t be enough money to take care of everything. We were concerned that we wouldn’t have enough money to pay off her bills and pay for her arrangements. This was something my mother should never have spent anytime worrying over, but she did. After her death, my sister was going through some of her documents and found that she actually had much more money than she herself was even aware of. My father had investments in stocks and bonds that she didn’t even know about. My brother and sister and I ended up with much more inheritance than she ever knew. It saddened us all to think our mother worried so over this and didn’t have the peace of mind of knowing everything was going to be ok. If there had been some way that she could have known this before, if we would have just taken the time to find out before hand. Worry is hard on the elderly and knowing that she did so was upsetting. Find out what there is and what will be needed. Plan ahead for that time when you will need to know. Financial Help: Many Elderly are living on a very fixed income and can’t afford much in the way of extras. They must budget their income very carefully and some struggle to the point that they give up many things they really need. If your paren’t is in a ssimilar situation and you or another family member aren’t in a position to help much, all is not lost. There are many programs available that could be of some help. Arrangements should be made early on for those times down the road where you paren’t will most likely need some sort of services to help them get by. These types of services will most likely be that of some type of in home care such as health care, or some other type of service. These types of services usually can run upwards of 19 dollars an hour. For many elderly, this can add up to draining their nest egg pretty quickly. Plan far enough ahead that this situation will not come as a major shock to both their finances and there emotional well being. The local Social Services organization is a wonderful resource that should be tapped into. This organization has government funded grants and monies to help. If you contact them and explain your situation with them, very often they will be able to help in some way. Another fine organization is the Area on Aging services and the Community Action group that also can be of great help. They to have monies allocated from the government for helping the elderly. Local branches of the American Red Cross provide Americans with help paying electric and heating bills. Often these particular organizations are given a certain budget that they have to last for a certain quarter or even on a yearly basis, therefore, it is important to contact them as soon as possible to be able to receive such funds. These two organizations would definitely be a good place to start when looking for some assistance. Many utility companies across the country offer support and assistance to Americans to help them pay their electric bills. Sometimes the utility companies will out source the administration of the program to the United Way. By contacting the local United Way office, you can see if they are aware of any assistance or support provided by any of the utility providers. The Cancer Care Co-Payment Assistance Foundation is a non-profit organization that provides financial assistance and cash grants to people who need assistance with paying hospital and medical bills that result from a cancer diagnosis. There are several programs that offer discounted and free prescription meducations. They include Dispensary of Hope, Together RX Access, NeedyMeds, and the Patient Advocate Foundation. The Meducations: I would first recommend that whowever is in charge of getting the meducations ready, get a weekly pill container to put them in. They even have these for the whole month if you want to do it that far in advance. This helps you organize the pills and keep track of them more efficiently. If the paren’t is still seeing that they take the pills each day, these little containers also help them not to take their meds twice, thinking that they might not have. If the pills are gone, they know they have and if the pills are still in the container by evening, they know they forgot to take their meducations and can still do so. The responsibility of taking care of the paren’t’s meducations can be very nerve racking, at least for me it was. Even when using the pill containers it can still be a difficult task. I think there was only a few times that I didn’t make a mistake while getting them ready for the week. I recommend after all the pills are in the container, that you to take the extra time and go back and check each container for the correct dosage. It’s better to be safe than sorry as they say. I remember when I was doing this job for my mother, it proved to be a very nerve racking job each week. It’s also very important that you stay up on refills so that you don’t get caught without a meducation during a weekend or a holiday when it might be difficult to get one. The pill containers seem to help with this as well, because you can see just when you’re getting low and when you need a refill. Do yourself and your paren’t a very valuable favor by doing some of your own research on the meducations that they are on. Don’t always trust the doctors, they see thousands of patients during the week and may not be taking the time to always look and see if something they are prescribing is going to conflict with something else that they are on. This has happened more times than any doctor would like to admit. My own mother was on sixteen pills a day towards the end of her life and at one time wasn’t making a lot of sense with her words. At first, we thought she was just going down hill health wise and that maybe she was getting Alzheimer’s or something worse. She got to the point that she had to be put on Hospice care and was taken off most of the meducations and miraculously regained her clear thinking within just a few short days. This led to her being taken off Hospice care altogether. This was an eye opener to my family that many of the elderly are over medicated in today’s society. â€Å"Sometimes, less is more†, is really true. Any quick search on the internet these days can tell you what any drug’s side effects are and in many cases you might even be able to find out what drugs shouldn’t be taken with certain other drugs. It’s just good to be educated on what is going on because no one is going to care as much for your loved one as you are. If you haven’t already done so, I recommend you make a very clear typed page that shows all the meducations that your paren’t is on and how often they take each one. I would make several copies of this document for family members to have. It’s a great idea to place one of them on the refrigerator, so that if an ambulance is ever dispatched to the home, it is in plain site for them to take it with them when transporting. This will alleviate much confusion on the way to the hospital and even after they arrive. Listed on this paper along with the meducations that they are taking, it is important to list any allergies or specific problems that you would want the ambulance crew to know about. The hospital will thank you as well, because they to will have to know this information once your paren’t arrives and is diagnosed. Many meducations can cause the patient to be less alert and therefore more prone to falls. Some of these meducations can be sedatives, anti-depressants, and anti-psychotic drugs. People that are taking multiple meducations are at greater risk of falling. Know the side effects of all the meducations that you are taking. Most pharmacists these days include a brochure with the side effects for you to read when dispersing the meducations. Fall Prevention And The Home: The most common reason for injuries to the elderly are due to falls. Falls account for 70% of the cause of accidental deaths in America for elderly persons seventy-five years and older. More than 90% of hip fractures occur because of falls. One third of community-dwelling elderly and 60% of nursing home residents will fall each year. There are many reasons that an elderly person will take a fall and because of their age it can be a devastating experience and in some cases even result in death. I remember once staying ith my mother for the evening and she got up to go to the kitchen and the next thing I heard was a terrifying crashing sound. I jumped up and ran to the kitchen with fear in my heart and found my mother on the floor. It really scared me, but luckily she was not hurt to badly, except for a few scrapes here and there. As I help ed her up I felt guilty for not jumping up as soon as I saw her going to the kitchen. The thought that I could have moved faster and gotten whatever it was that she was wanting and prevented her fall was all I could think of. Then I realized if I had not been there at all, she might have been confined to the floor for several hours. Not that this eased my mind that much, but it did open my awareness to how quickly something like that can happen. I felt blessed that she had not gotten hurt any worse. There are many things to consider when making a home Elderly proof. Just like making a home child proof, there are things that need to be done for the elderly. One of the biggest issues that the elderly have is that they have a high risk of falling. You can alleviate some of this worry by making sure the following is taken care of. Is the home setup in a safe way for the family member? Are there things that can be done to the home to ensure that it’s a safe environment? It’s a good idea to include anti scald devices for showers and faucets that protect older skin. The skin of an elderly person can sustain serious burns much easier than a youthful person. Take the time to set the water heater to the â€Å"low† setting or at 120 degrees. My mother was having trouble getting in and out of her bathtub and we were afraid that she might take a bad fall in doing so. We decided to tear out the old tub and install a walk in shower unit. This way she could just step into it and sit on her shower seat. We found out later that this was a very smart move because of the fact that several weeks later her sugar level dropped and she passed out and laid in the shower for over three and a half hours with the water still running on her. If she would have still had her tub, she might have drowned. Many elderly over the age of 65 have a fall each year. Most of the time these falls occur right in their own home while doing the things they have done for years. Here are some quick things to think about that I have come across in trying to help prevent a loved one from a serious fall. * Make sure all rugs are secure. * Get rid of any throw rugs that are present. * Do away with any slippery surfaces that might be a hazard to walk on. * If the loved one is bound to a wheel chair or uses a walker, or any other walking aid, make sure the pathway is clear enough for them to pass through without being a fall hazard. It’s sometimes a good idea to install handrails on both sides of the steps for better support. Many have even installed handrails in hallways to help prevent falls. * Make sure appliance cords are out of the way. Especially telephone cords and electrical cords. * Arrange furniture so that you can easily move around it. * Make sure furniture is easy to get in and out of. In some cases, purchasing a lift chair might be required. I would recommend shopping around when looking for these because there can be pretty big differences in price and quality. * Remove caster wheels from furniture. * Use a television remote control and a cordless phone. Avoid using floor polish or wax in order to reduce slick surfaces. * Keep commonly used items within easy reach. * A higher toilet seat can be very helpful to the paren’t as well. These help by allowing the paren’t to sit up higher and makes it much easier to get up from. * Put in a bedside light with a switch that is easy to turn on and off or a by a touch lamp. * Locate a telephone within the reach of the bed. * Adjust the height of the bed to make it easy to get in and out of. * Have a firm chair, with arms, to sit and dress in. * Install night lights where walking will be required. * Keep things off the floor that would create a haz ard for walking at night to the bathroom. As mentioned before, a tub seat is a very safe way for the paren’t to take a shower. These can be picked up in pharmacies or medical supply stores. * Add a nonskid mat to the bathtub. * Mounting a liquid soap dispenser on the bathtub wall will help prevent falls from trying to pick up fallen bars of soap. * Install a portable, hand-held showerhead. Physical Aactivity is very important: Up to 75% of elderly folks are not getting enough exercise in their lives. Regular exercise has so many health benefits in older adults when it comes to blood pressure, osteoarthritis, osteoporosis, lipid profile, and neurocognitive function. Improvements in cardiovascular, metabolic, endocrine, and psychologic health are well documented. Regular exercise has proven to help improve the quality of sleep, cognitive function and even helps with depression and short term memory. Probably the biggest effect that exercise has on the elderly is they gain much in the way of m How to cite Family First Alert, Essays

Starry Night Over the Rhone Painting by Vincent Van Gogh Essay Example For Students

Starry Night Over the Rhone Painting by Vincent Van Gogh Essay Starry Night Over the Rhine was painted along the banks of the Rhine River. What I first see when I look at this painting is the city lights reflecting off the water while a couple takes a walk on the nearby shore. The sky is filled with stars, including the Great Bear, commonly known as the Big Dipper. Van Gogh shifted the sky around in order to create an even more extraordinary display of stars. From his point of view the town of Arles lay to the south west; the Big Dipper he painted in the sky was actually in the north behind him. Starry Night Over the Rhà ´ne Towards the left you can see the towers of Saint Julienne and Saint Trophies, and the bridge connecting Arles to Tranquiller on the right. In the far horizon, a church steeple is shown. Starry Night Over the Rhine was described in a letter from Vincent Van Gogh as a cheerful piece, but when the painting was finished almost a year later, it had a revised mood and meaning. The work is dark, but serene. Many believe that the swelling depression in Van Gogh distorted the original sketchs romantic charm. This painting is a reflection of inner torment and mental distress. The animated strokes, the bright, vivacious colors of the stars contrasting against the dark blues and blacks of the night reveal his cry for hope, light and love. The focal point of Starry Night Over the Rhine is the constellation of the Big Dipper. Vincent Van Gogh brings attention to the Big Dipper by using color and value. The sky is the lightest shade of blue around the Big Dipper. The bright yellow stars in the constellation contrast with the blue to bring focus to them. Van Gogh uses the lines in the ground under the couple and around the edge f the water to make a circular motion that brings the eyes back to the focal point of the Big Dipper. Van Gogh also uses contrasting directional lines in the sky to make the stars stand out. The texture of the entire painting is very thick because of the method of impasto that Van Gogh used. A closer look at the Starry Night Over the Rhine reveals that Vincent Van Gogh gave equal visual weight to all the things that he painted. In this painting there is no visual distinction between the earth and the sky. Van Gogh shows unity throughout the piece with the lights, both natural and an-made. For every star or group of stars there is a city light or group of lights, which then has a reflection in the water. At the waters edge near the couple, it is nearly impossible to see the distinction between land and water. The low contrast makes it hard to tell whether the ship is sinking in the water, or merely Just docked. The bright lights have a high contrast to the dark blue-black sky and water. The way the water is depicted creates a rhythm that gives the illusion of waves rippling. The Starry Night Over the Rhine is an oil painting on canvas and the technique is broad ND sweeping brushstrokes. Vincent Van Gogh also used the technique of impasto in this painting. Impasto is very thick application of paint, usually wet on wet. This technique gives the painting texture and movement. Van Gogh painted rapidly, with a sense of urgency, using the paint straight from the tube. Van Gogh painted emotionally, trying to throw his heart onto the canvas and evoke feeling. (http:// www. DNA structure essays

DNA structure essays The remarkable feat of the discovery of the structure of DNA, in 1953, is usually associated with James Watson and Francis Crick. Maurice Wilkins also played a crucial role in this discovery, and he shared the 1962 Nobel Prize for Physiology/Medicine with Watson and Crick for the discovery. However, another important figure involved was the brilliant by short-lived Rosalind Franklin, for without whom the discovery would not have been possible. In the early 1950s, the race to discover the structure of DNA was on, and at least two groups were hot on the trail. At Cambridge University, a British graduate student Francis Crick and an American research fellow James Watson, where studying DNA by trying to create physical models to narrow down the possibilities and eventually create an accurate picture of the DNA molecule. At Kings College, in London, Rosalind Franklin and Maurice Wilkins were also studying DNA taking an experimental approach using x-ray diffraction as their main tool, allowing them to obtain images of DNA. Four main ideas had to come together to obtain the correct and accurate structure of DN@ the molecule was a double helix the strands were antiparallel specific base pairing the phosphate backbone was on the outside of the molecule and all these ideas where successfully demonstrated through the model proposed by Watson and Francis Crick (1916 -) began working at the Cavendish Laboratory at Cambridge University by 1949, where he was investigating the structure of proteins. In 1951 James Watson (1928 -), an American biochemist, joined the laboratory and the two formed a close working relationship. In the November of 1951, Watson attended a lecture by Franklin to bring the unit up to date on what she had achieved so far. Watson had not taken any notes, knew nothing about crystallography and had only a rather poor recollection of the facts the Frankl...

Sentencing Disparity Term Paper Example | Topics and Well Written Essays - 2500 words

Sentencing Disparity - Term Paper Example Moreover, this paper identifies the most important factor of prosecutorial discretion. It will also answer the question on whether or not sentencing disparity is fair or equitable. Finally, this paper will compare and contrast this disparity from the ethical point of view. People have an intuitive idea of the meaning of sentencing disparity. Paradoxically, the concept of unwarranted disparity becomes bleak upon deeper reflection. Two offenders, for instance, with the same crime of breaking and entering, are sentenced with one year and five years, respectively. Roberts (1999) posed an enduring question: Which sentence is disparate? They seem to emphasize the sentence or conviction that is categorically considered as disparate. Undoubtedly, there exists an unwarranted disparity in the case between the two above-mentioned offenders. In a survey conducted, 60 percent of over four-hundred respondents admitted that there is a degree of sentence variation among judges (Roberts, 1999). By and large, sentencing disparity occurs two or more offenders, having different committed crimes, are convicted with the same level and nature of punishment (Clear, Cole, & Reisig, 2009). And sentencing disparity is more obvious in the prosecutors’ judgment. Sentencing disparity is normative rather than empirical (Alschuler, 2005). Its archetype is the sentencing by lottery. In the lottery system, different numbers are treated as the same number by virtue of chance or probability. Similar to lottery, offenders with different crimes committed are equally treated like the same criminal by virtue of sentencing disparity. Equality, of course, means the consistent application of principles to different cases (Alschuler, 2005). Apparently, sentence disparity deviates from consistency or equality. There are three chief divisions of factors influencing prosecutorial discretion: (1) legal issue, (2) extralegal issue, and (3) resources issue (Siegel, 2008). First, legal issue refers to

Summary - Essay Example Tool testing and error rates find focus in the initial part of the guidelines. The use of a database approach for the documentation of the mobile forensics procedures assists in removing the documentation of testing methods employed, by acquiring results on the several test cases, enabling calculation of tool testing errors. This information enables the presenting of mobile forensic evidence in courts in a reliable and legally acceptable manner (Baggili et al, 2007). The practitioners of computer forensic quite often need to deal with digital images as a part of the evidence requirements. Such instances include child pornography or disputes involving proprietary rights. Photographic images found in computers have a strong likelihood of having originated from digital still cameras (DSC). Computer forensic practitioners should have an understanding of the characteristics of computer images to identify the origins of the DSC images in question. This understanding enables a computer fore nsic practitioner to use the specific attributes of a DSC image to prove replicas, derivates or additional images within a particular group. Some open source software can also be employed successfully to extract images based upon the characteristics of a DSC image (Kohen, 2007). Week – 3 The usage of the iPhone mobile from Apple is growing rapidly. This has led to the need for iPhone forensics as a part of the armory of forensic and security practitioners. This study shows that it is possible to examine the logical back up acquisition of the iPhone 3GS mobile device using the Apple iTunes back up utility to provide forensically important data in the form of e-mail messages, text and multimedia messages, calendar events browsing history, GPRS locations, contacts, call history, and voicemail recording. The study explored the possibility of forensic acquisition, examination and analysis of the backup of the logical copy in the iPhone 3GS mobile. In the examination process the ai m was to find out what significant data was stored in the on the device, location of its storage in the memory, and where the data is located in the back up files. For the acquisition the freely available iTunes back up utility was used in a systematic manner to synchronize data between the iPhone and a paired computer. Testing of this methodology demonstrated that an iPhone mounted on a computer running iTunes does not change the user data portion, which means that data integrity remains intact. When a logical copy is acquired, several hundred backup files containing user data, device settings, application preferences, and status are obtained. All these back up files are encoded into XML, ASCII, or binary formats. Examination of the logical copy from an iPhone reveals that these back up files contain a wealth of data that has the potential for use as evidence in court cases (Baggili & Bader, 2010). Week – 4 Amendments made to the Federal Rules of Civil Procedure effective fr om December 1, 2006, addresses the issue of Electronically Stored Information (ESI), which also takes into consideration ESI found in small digital devices, like cell phones and Personnel Digital Assistants and their use as evidenced in court procedures. The Topic Of Feminism And Womens Rights History Essay

The Topic Of Feminism And Womens Rights History Essay Nellie McClung was born Nellie Letitia Mooney, in Chatsworth, Ontario, Canada on October 20th, 1873 to a Scottish Presbyterian mother and an Irish Methodist father. She was the youngest of six children; at the age of six, she would move to Manitoba with her family. She would end up spending the duration of her life in western Canada. From a very young age, McClung showed an acute awareness and interest in the issue of female equality. In her autobiography entitled Clearing in the West, McClung cites the story of attending a picnic in her hometown of Winnipeg in 1882. The city had suffered from tremendous flooding and a collapse of the real estate market, and to uplift the morale of the community, a picnic was organized. The organizers of the picnic arranged for organized sports where there would be races held for the boys. The young McClung desperately wanted to participate in the race and hoped that there would also be races held for young girls. She stated, The whole question of gi rls competing in races was frowned on. Skirts would fly upward and legs would show! And it was not nice for little girls, or big ones either to show their legs. I wanted to know why but I was hushed up. It was that type curiosity and questioning of the status quo that marked McClungs life and would ultimately lead her to demand female equality. As an adolescent, McClung would go on attend school for a period of five years until she was fifteen. When she was sixteen she completed her teachers training and was hired to work in the small town of Manitou which is located in the southwest of Manitoba. Throughout her career as a teacher she would make a conscious effort to allow her female students to partake in sports alongside their male counterparts. This was an important time in her life; while in Manitou she would board with the Reverend James McClung and his wife Annie. Annie played an extremely influential role in the life of Nellie; Annie McClung was the president of the local chapter of the Womens Christian Temperance Union and it was Annie who encouraged Nellie to participate in social activism. McClungs was also influenced by her Christian faith and her love for education. It was those two influences along with the influence of Annie McClung that would ultimately lead her to associate with the Womens Christian Temperan ce Union. Coincidently, Annie would also become Nellies mother in law as Nellie would marry her son Robert Wesley McClung. . Nellie was very close to Annie and in her autobiography she stated that Annie was the only woman I have ever seen whom I would like to have as a mother-in-law. Nellie McClung would marry Robert Wesley McClung in 1896. By all accounts they had a very successful and loving marriage. Robert always supported Nellie and encouraged her to carry on in her struggle for female equality. They would go on to have five children. In addition to being a mother and a social activist, Nellie was also a best selling author and journalist. As a young girl, her brother Will gave her a series of novels written by the great English author Charles Dickens. They quickly became her favorite reading; she admired Dickens as a writer and was also greatly impressed by the social critiques that Dickens wrote about. The influence that Dickens had on the life of McClung was clearly evident in her autobiography in which she stated that she wished to do for the people around me what Dickens had done for his people. I wanted to be a voice for the voiceless as he had been a defender of the weak McClung would go on write over sixteen novels, in addition to numerous short stories and poems. What she stood for and What she Accomplished Nellie McClung embraced a number of causes including but not limited to: temperance and then prohibition; female equality and suffrage, the involvement of women in politics, and even the ordination of women in church. Even though there are many contemporary historians who criticize first wave feminists for evoking the ideology of maternal feminism, it would not be accurate to simply label McClung as only a maternal feminist. While it is true that she often evoked womans moral superiority over men she took different approaches at different times in her life, and used both maternal feminism and universal equality as arguments to advance the status of women. Also, one has to keep in mind the social environment that existed at the time period. One of the major tasks of a historian is the ability to empathize with the subject being studied. A historian has to be able to get at the mentality and the psyche of the people or time period being studied. During the early nineteenth century, a womens rights activist could not be expected to rely on the principle of universal equality of the sexes to bring about the advancement of women. Also, the idea of maternal feminism is not unique to Canadian female activists. Similar tactics were used in America, Britain, and even in as distant a country as Russia. One of the earliest causes that Nellie McClung embraced was that of temperance. As has already been stated, Nellie was introduced to the cause by her mother in law Annie. Annie was the president of the local chapter of the Womens Christian Temperance Union. From a young age Nellie experienced the negative effects that alcohol had on the family. She saw numerous husbands and fathers drinking away the family wages to the detriment and neglect of their wives and children. Men would often come home in a drunken state and physically abuse their spouses and/or their children. Battered women were in a state of legal helplessness as they were considered dependants of their husbands and did not possess any property rights. Nellie McClung began to champion the cause of temperance and eventually outright prohibition. Nellies involvement with the Womens Christian Temperance Union eventually led to her involvement with the Political Equality League. One of Nellie McClungs most endearing qualities was that she possessed great foresight. She understood that prohibition was only part of the problem. McClung strongly believed that women needed the right to vote. She felt that without the right to vote, women lacked the political clout necessary to influence politicians to enact legislation that would remedy the problems of both alcohol abuse and spousal abuse. It was because of this that Nellie expanded her social activism to include not just prohibition, but also womens suffrage. McClung belonged to two different groups that both worked for womens suffrage, they included the Canadian Womens Press Club and the Political Equity League. Her most prominent opponent was the Premier Rodmond Roblin of Manitoba who, like most men in his day, felt that women did not belong in the public sphere. He even went so far as to use the rhetoric of maternal feminists against them saying: Does the franchise for women make the home better? My wife is bitterly opposed to woman suffrage. I have respect for my wife; more than that, I love her; I am not ashamed to say so. Will anyone say that she would be better as a wife and mother because she could go and talk on the streets about local or dominion politics? I disagree. The mother that is worthy of the name and of the good affection of a good man has a hundredfold more influence in moulding and shaping public opinion round her dinner table than she would have in the marketplace. Nellie McClung and her fellow suffragettes did not lose hope. On January 27, 1914, they approached the Manitoba legislature to present their case. They were quickly rebuked by Premier Roblin, His speech was so illogical and nonsensical that Nellie was actually delighted. She continued to campaign for the womans vote. She staged a play and a mock parliament called the Womens parliament in which she showed just how illogical the position of the Premier was. She had the audience in stitches with her use of humor and sarcasm. To Nellies delight, Premier Roblin was removed from office because of an unrelated political scandal and was replaced by a Premier who was much more supportive of womens rights. Like many politicians, once in office the new Premier T.C Norris changed his position and said he could only bring in the female vote, if the suffragettes were able to demonstrate that there was sufficient support for their position. Nellie McClung responded by presenting a petition with ove r 40,000 signatures of her supporters. On January 27, 1916 the Bill for Enfranchisement of Women was passed and women in Manitoba were granted the right to both vote, and run for office. Nellie was also successful in her campaign for prohibition as prohibition would come into effect in the province of Alberta on July 1, 1916 as a result of a non-binding referendum or plebiscite. Another important accomplishment for McClung was the famous Persons case. When Nellie was born in 1873 she was not a person under Canadian law. That meant that a woman possessed few legal rights and even fewer property rights. In early 1928, the Supreme Court of Canada ruled that the word person in section 24 of the British North America Act did not include women. Nellie McClung along with four other women who came to be known as the Famous Five petitioned the government to expand the legal definition of Persons. They appealed to the Privy Council of London to overturn the ruling of the Supreme Court. On October 18, 1929 the Privy Council ruled in favor of the women and expanded the definition of Persons to include women. That allowed women to serve as members of the Senate of Canada. In 1921, Nellie McClung would go on to run for election as a member of the Liberal Party of Alberta. She was successful in her bid, but the Liberals were defeated by the United Farmers of Alberta Part y. McClung would end up serving in the Legislative Assembly for a period of five years. One aspect of Nellies social activism that is often overlooked was her support for eugenics and a broader sterilization program. Nellie was an ardent supporter of eugenics which literally means well-born. Eugenicists believed that they could improve society by instituting a process called selective breeding. Nellie McClung and other eugenicists believed that people with physical and/or mental disabilities should not be allowed to procreate and that they were not entitled to have children. Because of the ill-conceived efforts of eugenicists such as Nellie McClung, the province of Alberta passed The Sexual Sterilization Act in 1928. Following the passing of that piece of legislation, a province-wide sterilization campaign was launched in which thousands of women were sterilized. Research indicates that many women who were sterilized did not even possess any genetic defects. Research also indicated that a disproportionate amount of teenage girls and aboriginal females were the ones who were targeted for sterilization. It was unfortunate that someone who was so involved in social activism should have such an enormous blemish tarnish her legacy. In Nellies defense, eugenics was a dominant social theory at the time, and while that may serve as a mitigating factor, it does not excuse her actions. Nellie constantly fought against the status quo and social norms, it seems unfathomable that she would support such a despicable cause. Notwithstanding Nellie McClungs shortcomings, she was a remarkable woman. She was not only a wife and mother, but she was also a journalist, a politician, and a social activist. This essay was not even able to cover the full scope of Nellies activism. In addition to fighting for prohibition, womens suffrage, and womens legal equality, Nellie was also highly involved in campaigns to improve working conditions in factories, and also in allowing the ordination of female ministers in the church. Nellie was also a distinguished author; she published numerous novels, short stories, poems and other literary works. While critics may criticize her for her evoking the ideology of maternal feminism and for her support of eugenics, one has to take into account the mentality of the time period. Nellie was a product of her environment, and she was undoubtedly influenced by her surroundings. Nellie McClung deserves to be remembered as one of the greatest Canadians to have ever lived.

You may not be familiar with all of them, but do not be alarmed. They are all easy to master in the end. Let’s start with the grocery list and move you into the process slow and steady. I will list the required measurements beside each item. They are not in any special order. ? One 4-6 pound Beef Tenderloin – (a specific cut of beef) ? ? cup of diced onions ? 5 tbsp + 3 tsp of Extra Virgin Olive Oil ? 10 cloves of garlic – 4 minced completely and 6 peeled – gently smashed (you can do this as you peel them, it is easier to get the peel off the cloves if you lay the flat edge of your chef or butcher knife on the clove and hit the topside of the blade with your fist.) ? 1 cup sliced mushrooms – your choice of type ? 6 tbsp unsalted butter at room temperature ? 2 tbsp salted butter (melted) ? 1 pkg frozen puff pastry – you will need at least 1 ? of the 2 in the pkg. ? 4 tbsp Kosher or Sea Salt, mainly due to the texture ? 2 tsp plain salt ? 4 tbsp fresh cracked black or multicolored peppercorns ? 1 egg + 1 tbsp water mixed together to make an egg wash ? Cooking spray (such as Pam) ? 2 – 3 tbsp all purpose flour for dusting your work surfaces ? 4 tbsp Red Wine – any kind as long as you enjoy the taste yourself.Do not ever cook with wine that you would not drink yourself. You can substitute this with cooking wine if you like. Now I will list the utensils you will need for the preparation of this dish. You will need to gather the required items and have them in your reach when you begin to prepare the dish. Having all the ingredients and required utensils within easy access helps the process go more smoothly. So take a few minutes to gather everything you need for this adventure, set it up in a clean, spacious area of your kitchen so it will be well organized before you begin. Trust me, this will help so much.? A copy of this recipe in a zip-lock bag to keep it from getting dirty. You can tape it to the wall or prop it up somewhere easy to see at eye level. ? 1 large Chef or Butcher knife that you are comfortable using ? 1 long, bladed Fillet Knife – very sharp ? 1 pair of tongs ? 1 large skillet – one big enough to lay the tenderloin inside to sear the sides ? 1 large roasting pan with a rack in the bottom to keep the roast off the pan surface ? 1 flat baking sheet with at least a ? inch lip – lined with aluminum foil ? 1 Pastry Brush ? 1 Rolling Pin ? 1 large cutting board? 1 Gallon size Zip-lock bag ? Cooking twine ? Scissors ? Measuring Cups ? Measuring Spoons ? 1 medium mixing bowl ? (Optional) Small cookie cutters in leaves, circles or crescent shapes Arrange all of your ingredients and utensils around your work station. Doing this will ensure the most comfortable way that works for you when it comes time to start. Preparation of the various items that need to be chopped, minced, diced, etc. , will speed the process up when you begin to work on the actual dish. When you feel comfortable with your arranged supplies and ingredients, you can begin.Step 1: To get everything started and underway, please preheat your oven to 400 degrees. Place the skillet on the stove and heat it on a medium high temperature. When the skillet begins to warm you can add the 2 tbsp of Extra Virgin Olive Oil, 1 tbsp butter and a pinch of salt & cracked pepper. As the ingredients begin to melt down, drop in your diced onions, 4 minced cloves of garlic , the entire cup of mushrooms and the 4 tbsp of red wine. Saute them on medium high until the onions are translucent, the wine has reduced in volume and the mushrooms are tender, yet not falling apart.Remove from the skillet and allow to cool while we mix the other ingredients together for the filling. Step 2: To prepare the filling for the tenderloin you will need to mix together the following ingredients: 4 tbsp softened butter, your sauteed onions, mushrooms and garlic mixture after they are cool enough to handle. Mix very well until you form a creamy spreadable butter mixture. Now we are ready to prepare the tenderloin. Step 3: To prepare the tenderloin you will need the cutting board and the fillet knife.. If you have never filleted a piece of tenderloin before, it is not really that hard.I will walk you through the steps. First you need to lay out your tenderloin on the cutting board facing you lengthwise. Place the knife on the left side end of the tenderloin and make an inci sion into the tenderloin about 1 – 1 ? inches thick. Slowly continue to cut along the length of the tenderloin until you reach the other end, trying your best to keep the depth of your cut as even as possible. When you reach the end, you start over again but going the opposite direction making sure to keep the same depth of your cut until you are able to lay the tenderloin out completely flat on your cutting board. You have just filleted a cut of beef. See, it was not that hard. Step 4: Take your butter mixture, place it in spoonfuls onto the flat tenderloin and rub it very generously all over the tenderloin, allowing about ? inch at one end with no mixture — that will be your top sealing flap. After you have rubbed all the mixture into and all over your tenderloin, begin to roll the tenderloin back onto itself lengthwise, forming the round tenderloin as before you cut it, just now with lots of yummy stuffing inside.Wash your hands very well, grab your kitchen twine and cut 5 – 7 equal pieces of twine about 16 – 18 inches long. You will take each piece, wrap it around the diameter of the roll starting at one end and work your way to the other, tying up the tenderloin so it will hold together while you sear it for sealing. Do not worry about the extra string, just cut off the excess after you finish tying up the entire piece of tenderloin. By this time the tenderloin should be at room temperature which is the perfect degree to get a sear on the tenderloin without it becoming tough and chewy.Always let your tenderloin rest at room temperature or close to that before placing it inside a hot pan so you do not have all the tiny tendons and muscles that are woven inside the tenderloin seize up and shrivel. That is what happens when you put a cold piece of beef into a hot skillet, grill or pan, and that is how it becomes very tough. Step 5: Now we are going to sear our tenderloin, but before we do this, we need to heat the remaining butter inside the skillet allowing it to become very hot, but do not burn the butter! It will taste horrible and you will have to wash out the skillet and start all over again.Drizzle the 3 tsp of olive oil onto the tenderloin’s outside surface and rub it all over the tenderloin. Combine the remaining Kosher salt and the 3 tbsp of the cracked peppercorns to sprinkle all over the outer surface of the tenderloin after you coat it with the olive oil, do not forget about the ends of the tenderloin, they need love too. Step 6: With your skillet growing hot on medium high to just above medium high, take your tongs and lift the tenderloin up, placing it into the searing hot pan on the seam side first. Leave it on that side at least 3 – 4 minutes for the proper crust to form on the outside of the tenderloin. Now repeat this all over the entire tenderloin, making sure you do not forget the ends for this step as well. You will have to hold the tenderloin with your tongs as it stands on end to sear the end pieces but trust me it is totally worth it. When you are done with searing the surface of the tenderloin, it should look crispy / crunchy and a deep golden brown, do not let it burn, watch it very closely during the searing process. It is a fine line at this point between searing to the perfect golden crunchy exterior and burning it into a piece of shoe leather.Remove the tenderloin and skillet from the stove top and place the tenderloin aside to rest about 10 – 15 minutes while you prepare for the next step in this process. Allowing the tenderloin to cool somewhat will help when it comes time to wrap it in the pastry. Step 7: We will now start on pastry preparation. The puff pastry usually comes in two folded sheets for each package. You will need both of them to be almost room temperature and pliable but not totally thawed out. The dough would become to flimsy if completely thawed. It will rip and tear when you are try to stretch, move or roll it out. Pas ty dough always works better when cool to cold, so when you are preparing any kind of dough, do not do it near the oven or any source of heat if you can help it. Dust the clean surface of your work area with flour, but reserve some for your rolling pin and hands. Unfold the sheets of pastry out onto the floured surface. Now take your rolling pin, dust it with flour and begin to roll out the creases in the dough so it will seal properly and not crack or break when you are rolling it around the tenderloin. As your are rolling out the dough make sure you do not over work it too much and keep dusting with flour as needed to prevent the dough from becoming tough when baking. Now you can size up the width and length of the pastry either by your eye or you can measure it. Basically it needs to be long enough to wrap around the girth of the tenderloin with a 1 inch edge to overlap when you finish. That is the piece that is used to seal the seam along the bottom of the tenderloin. You also ne ed at least 1 ? to 2 inches left on the width of the pastry to seal the ends of the tenderloin. If it seems that you are going to need extra dough on the width or length, cut sections from the second sheet of dough, brush the adjoining ends with egg was and overlap them. Pinch the dough together to form a seal and roll out the seams until flat. Patch work is easy and sometimes necessary, but do not worry. You can use the seam to roll under the tenderloin and once you have it wrapped around the meat, you can smooth it out with your hand or cover it with decorations. The same goes for the ends, they are supposed to look like the crinkled, crimped ends of a sausage.Creases are supposed to be there. Just make sure you take your time, do not get frustrated and use the egg wash to help with the seal. Step 8: Now that you have sized up your pastry, make your egg wash. Beat 1 egg in a small bowl with 1 tbsp water until the mixture is slightly frothy or bubbly. Step 9: It is now time to remov e the twine from the tenderloin. The tenderloin should be cool enough that you can handle it. Be gentle removing the twine so the tenderloin does not begin to unroll while you are removing the twine. You can either use tongs, the serving fork or your hands to hold it steady while removing the twine. Cut each piece twine with your knife and pull it from around the tenderloin. Place the tenderloin at the top of the pastry dough with both facing you lengthwise. Making sure you will be able to roll it towards you to see that the dough is not tearing. This also helps to make sure that the patches, if you had to make any, do not break apart as you roll them and you can catch it in case repair in needed. Step 10: Begin rolling the pastry and tenderloin towards you.Make sure the entire piece is covered with pastry as you roll. There should be a 1 ? – 2 inch piece of dough hanging over at each end of the rolled tenderloin when complete. With a pastry brush, apply egg wash to the sectio n of pastry at the end of the roll closest to you. Brush egg wash on the dough already around the pastry where the two sections are going to overlap also. This will help secure the seam you are going to create. By pinching the two sections of overlapping dough together that have the egg wash â€Å"glue† on them you will form a seal of dough.Smooth the seam out with your fingers after you are satisfied it is sealed. This side will be on the bottom of the baking pan so if it is still a bit lumpy that is alright. If you need extra dough on the ends to help complete the seal of the tenderloin use some of the excess scrape pieces you have left over. To seal the ends, fold down the edges starting at the top and working your way around, overlapping the dough and crimping the ends together like a roll of sausage. This is where you can use patchwork if you need a little extra dough just to seal it completely.Brush each end with egg wash to help hold the seal here also. Step 11: Now fo r an elegant touch, you can take small cookie cutters in the shape of leaves, crescent moons or circles and cut shapes of the remaining dough to place on top of the finished roll before placing it in the oven. Make sure you brush the top of the tenderloin again with egg wash if you added these. Step 12: Take your cooking spray and spray the baking sheet lined with foil very generously so the pastry will not stick to the foil.Make sure you have brushed the top and sides of the tenderloin pastry with the egg wash very well before placing the tenderloin, seam side down, on the foil lined baking sheet. Place the baking sheet on the middle rack in the center of the oven. Bake at 400 degrees for 13 -16 minutes. This step will help keep the puff pastry crunchy all over, while still cooking the tenderloin long enough to have the slow roasted taste. When the top of the crust starts to become a light golden brown, remove the tenderloin from the oven and check the bottom of it.Has the pastry f ormed a good crust on the bottom or is it still soggy looking? It needs to have a good crust started before we can move it to the roasting pan. If there are still a few soggy parts on the bottom, cover the pastry with a piece of aluminum foil so it doesn't start to burn. There needs to be enough foil to fit down both sides and the ends of the tenderloin roll to ensure the pastry does not overcook and begin to burn during this part. Place the baking sheet back in the over for another 8 or so minutes, checking about 5 – 6 minutes in just to make sure it does not burn on the bottom.Step 13: When the pastry wrapped tenderloin becomes crunchy on the bottom, light golden brown on the top and smells like heaven, it is time to add the final touches and allow it to slow roast a little longer to infuse all the wonderful flavors even more. In the bottom of the roasting pan, put the 6 smashed garlic cloves, 2 tsp salt and the 3 tbsp of Extra Virgin Olive Oil. Just scatter them around und er the baking rack. Now place the tenderloin, seam side down, on the rack inside the roaster. Allow the foil â€Å"hat† that we used already to cover the pastry to stay on for the first 20 minutes. If you did not have a foil â€Å"hat† earlier then please make one now so the pastry does not burn during this cooking stage. It needs to cover the sides and all across the top of the pastry. When the 20 minutes is up, remove the roaster from the over and remove the foil â€Å"hat† from the the tenderloin. Check the pastry for any soggy areas underneath or on the ends. Melt the last 2 tbsp of salted butter and with the pastry brush, slather all of the butter on top of the pastry dough, its sides, edges, everywhere you can reach.Don't worry about the bottom it will run down there and help with the final roasting of the garlic cloves as well. Place the tenderloin uncovered back inside the oven for an additional 15 minutes making sure that you get a golden brown crust on the pastry and do not let it burn. Different ovens vary in temperature and cooking times, please watch your crust to make sure it does not burn. You can reduce the cooking time or increase it as you are cooking this to work with your specific oven. Step 14: Remove the roaster from the oven.Allow the tenderloin to sit in the roaster for about 5-7 minutes, then move it to the cutting board to rest for at least 10 – 15 minutes more. This will help with the settling of the juices inside the meat, it will also help when you go to cut it so the pastry does not tear so easily. While your meat is resting, you can be finalizing your side dishes, table arrangements or just sit there and smell how good it smells until you finally get to cut into it. Step 15: The last step in the preparation of this amazing meal centerpiece is the cutting of the tenderloin. The key to cutting a perfect piece is to make sure your knife is extremely sharp. Serrated edged knives are best due to the pastry, h owever, if you prefer a chef's knife, sharpen it very well before you cut into this beautiful masterpiece. I prefer to use the tongs when trying to stabilize the tenderloin for the cut of first slice or two. Poking into the crust with the serving fork right off the bat sometimes allows more juices to run out of the meat while you are trying to cut it and the pastry becomes soggy and tears. So start at the end of your choice and move your knife about 1 to 1 ? inches into the body of the tenderloin. Steady it with your tongs and make one smooth slice from one side of the tenderloin to the other using the full length of the knife, drawing it from the handle down all the way to the tip. Then if you need to go back and slice again, repeat the same step. This will ensure that you are not tearing up the meat or the pastry. This is the conclusion of my special way of cooking Beef Wellington. I hope you will enjoy this dish as much as I have.Preparing it and eating it are both a joy to me. I hope it will be that way for you also. Never let a cookbook scare you into submission. Everything is worth trying to do when it comes to food. You might have to try some things over and over again to get it just the way you like it. The final product regardless of how many times you made it will be worth it. When your family and friends can't stop telling you how wonderful it is, you can tell them it was easy and just smile. Who knows you could have a magic touch
